Terms of Service
1. Who we are and acceptance of these terms
Wildpack is operated by Jack Maclay, trading as Wildpack, a sole trader based in the United Kingdom (not a registered company). These Terms of Service ("Terms") are a contract between you and Wildpack. By creating an account or using the Wildpack app, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the app.
2. Eligibility
You must be at least 13 years old to use Wildpack. If you're between 13 and 15 (or the "age of digital consent" set by your country, if higher) you should have a parent or guardian's permission. By using Wildpack you confirm you meet this age requirement.
3. Your account
You're responsible for keeping your login credentials secure and for all activity under your account. Tell us at hello@wildpackapp.com if you think your account's been compromised. You must provide accurate information when creating your account (e.g. a real, working email address).
4. User-generated content
Wildpack is built around content you and your friends create: photos, written descriptions, scores, event/card-pack data, and friend connections ("Content").
Ownership: you keep ownership of the Content you create and upload. By uploading Content, you grant Wildpack a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and process that Content solely to operate the app's features (e.g. showing your card to your group, generating the reveal, letting a group vote on photos). This license ends when you delete the Content or your account, except where a copy needs to be kept briefly for backup/legal purposes or where other members' events genuinely depend on it (see the Privacy Policy's Data Retention section).
Prohibited content. You agree not to upload or submit Content that:
- Depicts a real person without their knowledge or consent, in a way that could embarrass, expose, or harm them (Wildpack is designed for consensual, friendly use among people who know they're part of the group/event)
- Is harassing, abusive, threatening, or intended to demean or bully anyone, whether in a photo, description, or score
- Is sexually explicit, especially involving anyone who may be a minor
- Infringes someone else's intellectual property or privacy rights
- Is illegal in the jurisdiction where you or the subject are located
We reserve the right to remove Content that violates this section and to suspend or terminate accounts responsible for it (Section 7).
5. Acceptable use
In addition to the content rules above, you agree not to:
- Use Wildpack to harass, stalk, or endanger another person
- Attempt to access another user's account without permission
- Reverse-engineer, scrape, or interfere with the app or its infrastructure
- Use Wildpack for any commercial purpose we haven't authorised (e.g. reselling access)
- Circumvent any age, content, or access restriction we put in place
6. Reporting and moderation
If you see Content or behaviour that violates these Terms, or you want to leave an event, or you want us to remove a card that's about you: Wildpack doesn't yet have a self-serve report or "leave event" button in the app — that's a planned feature, not yet built. Until it ships, email hello@wildpackapp.com with the event name/code and details, and we'll review and act on it as quickly as we can, which can include removing Content, removing a member from an event, or suspending/ terminating an account.
7. Suspension and termination
We may suspend or terminate your account, with or without notice, if you violate these Terms (especially Sections 4 or 5), if required by law, or if we discontinue the Wildpack service generally. You can stop using Wildpack and request account deletion at any time by emailing hello@wildpackapp.com (see the Privacy Policy for how this is handled while it's a manual process).
8. Physical card packs (future feature)
We plan to eventually offer printed physical versions of your event's card pack as a paid feature. This feature does not exist yet. When it launches, it will be governed by separate commerce terms covering payment, shipping, returns/refunds, and our print-on-demand vendor's own terms, which we'll publish and link from here before the feature goes live. Nothing in these Terms currently commits us to offering physical packs on any particular timeline.
9. Disclaimers
Wildpack is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the app will be uninterrupted, error-free, or secure at all times. We don't review Content before it's shared within a group, and we're not responsible for the accuracy, appropriateness, or legality of Content users submit, though we will act on reports as described in Section 6.
Nothing in this section limits any statutory rights you have as a consumer that can't lawfully be excluded (e.g. under UK consumer protection law).
10. Limitation of liability
To the fullest extent permitted by law, Wildpack (meaning the sole trader operating it) is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or other intangible losses, arising from your use of the app. Wildpack's total liability to you for any claim arising from these Terms or your use of the app is limited to the greater of £50 or the amount you've paid us in the 12 months before the claim arose (currently £0, as the app is free).
This limitation doesn't apply to liability that can't lawfully be limited or excluded, such as liability for death or personal injury caused by negligence, or fraud.
11. Indemnification
You agree to indemnify and hold Wildpack harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the app, including Content you upload.
12. Governing law and disputes
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of Wildpack will be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you're a consumer resident elsewhere in the UK or in the EU/EEA, mandatory local consumer protection laws may still apply and you may bring proceedings in your own country's courts where local law requires it.
13. Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, for significant changes, notify users in-app or by email before the change takes effect. Continuing to use Wildpack after a change takes effect means you accept the updated Terms.
14. General
- Severability: if any part of these Terms is found unenforceable, the rest remains in effect.
- Entire agreement: these Terms, together with the Privacy Policy, are the whole agreement between you and Wildpack regarding the app.
- No waiver: if we don't enforce a provision, that's not a waiver of our right to enforce it later.
- Assignment: we may assign these Terms if Wildpack is transferred to a successor entity (e.g. if the business is later incorporated as a limited company); you may not assign your account or rights under these Terms to anyone else.
